General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter the "Terms") govern the contractual relationship between the company SMARTO SAS, with capital of €200,000, registered with the Nanterre Trade and Companies Register under number 800 571 937, whose registered office is located at 10 rue Jacques Daguerre, 92500 Rueil-Malmaison (hereinafter "the Seller") and any individual or legal entity wishing to make a purchase via the website caralgo.com (hereinafter "the Buyer").

The products offered for sale are:

• The CarAlgo dongle: a connected OBD diagnostic device
• Access to the CarAlgo app and its features

The essential characteristics of the products are presented on the caralgo.com website. Photographs and illustrations are as accurate as possible but are not binding on the Seller.

Prices are shown in euros, all taxes included, for mainland France and the European Union. The Seller reserves the right to change its prices at any time, while guaranteeing the price in effect at the time of the order.

The Buyer places an order on the caralgo.com website by following this process:

1. Product selection
2. Vehicle compatibility check
3. Delivery information
4. Payment method selection
5. Order confirmation and payment

Confirming the order constitutes acceptance of these Terms and serves as proof of the sales contract.

Payment is made by credit card via the secure Stripe platform. The full price is due on the day of the order. If payment authorisation is refused, the order will be automatically cancelled.

• Mainland France: delivery within 2 to 5 business days
• International: delivery costs vary by destination, 5 to 10 business days

In accordance with Article L221-18 of the French Consumer Code, the Buyer has 14 days from receipt of the product to exercise their right of withdrawal without giving any reason or paying any penalty. The product must be returned in its original packaging, complete, in perfect condition and with all its accessories. Return shipping costs are the Buyer's responsibility.

Products are covered by the legal guarantee of conformity (Articles L217-4 to L217-14 of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). The CarAlgo dongle also comes with a 2-year commercial warranty from the date of purchase.

Personal data collected is processed in accordance with our Privacy Policy. The Buyer has the right to access, rectify and delete their data.

SMARTO SAS's liability is limited to the purchase price of the product. Under no circumstances may SMARTO's liability exceed this amount. SMARTO cannot be held liable for indirect, incidental or consequential damages resulting from the use or inability to use the product.

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, the French courts shall have sole jurisdiction. In the event of a dispute, the consumer is informed that they may use a consumer mediation service free of charge, in accordance with Articles L. 611-1 et seq. of the French Consumer Code.
