Terms of Use of the CarAlgo Application

These Terms of Use (hereinafter the "Terms") set out the conditions under which users (hereinafter the "User") may access and use the CarAlgo application (hereinafter the "Application"), published by SMARTO SAS.

The CarAlgo application is published by SMARTO SAS, with capital of €200,000, registered with the Nanterre Trade and Companies Register under SIRET number 800 571 937 00039, whose registered office is located at 10 rue Jacques Daguerre, 92500 Rueil-Malmaison.

CarAlgo is a mobile application offering a connected-vehicle solution that tracks vehicle data and analyses trips, eco-driving, driving behaviour and vehicle diagnostics.

The application is free, but its use requires the purchase of a dongle to retrieve vehicle data.

The application also offers a privacy mode, which the user can activate at any time, allowing them to temporarily suspend the collection and recording of vehicle activity, in particular GPS location data.

Access to the CarAlgo application is reserved for users with a personal account. Creating an account requires providing a valid email address and a password. The user agrees to provide accurate information and to update it in the event of any change.

CarAlgo collects and processes the following personal data: email address, password, vehicle registration number, GPS position, as well as all data from the dongle connected to the vehicle. This data is necessary for the service to function and is processed in accordance with applicable regulations.

The user can activate privacy mode at any time to temporarily stop the collection of this data, in particular GPS position, thereby ensuring better control over their privacy.

The user agrees to use the application in accordance with its intended purpose. It is prohibited to use the application for fraudulent or unlawful purposes. CarAlgo does not offer any content-publishing features.

All content on the Application, including but not limited to text, images, logos and trademarks, is the exclusive property of SMARTO SAS or its partners. Any unauthorised reproduction or use is prohibited.

SMARTO SAS cannot be held liable for direct or indirect damage arising from the use or inability to use the CarAlgo application, in particular in the event of technical failure, temporary unavailability or data loss.

The User may terminate their account at any time via the Application's settings or by contacting support at: contact@caralgo.com. SMARTO SAS reserves the right to suspend or delete a user account in the event of non-compliance with these Terms.

These Terms are governed by French law. In the event of a dispute concerning their interpretation or performance, the courts of Nanterre (92000) shall have sole jurisdiction.

The detailed rules on personal data are described solely in the Privacy Policy, in order to clearly separate the Terms of Use from the privacy policy.
